Des droits dits de revendeur sont ainsi attribu\u00e9s. Seuls les partenaires autoris\u00e9s ont le droit de vendre des licences logicielles et sont obligatoirement membres du programme de partenariat correspondant du fabricant. Les revendeurs obtiennent le droit non exclusif de commercialiser et de distribuer activement des logiciels sous licence au sein de l'UE\/AELE. Par d\u00e9rogation \u00e0 cette r\u00e8gle, les partenaires de distribution peuvent \u00e9galement \u00eatre actifs dans d'autres r\u00e9gions ; cela n\u00e9cessite un accord \u00e9crit.<\/p>\n<p>Le revendeur est tenu de proposer les produits logiciels sous les noms de produits respectifs du fabricant. Les mentions pertinentes relatives aux droits de propri\u00e9t\u00e9 et aux droits d'auteur doivent \u00eatre respect\u00e9es ou effectu\u00e9es. Tous les noms de marque et les marques d\u00e9pos\u00e9es sont la propri\u00e9t\u00e9 des fabricants respectifs. Les indications techniques doivent toujours correspondre aux indications du fabricant. Les illustrations, ic\u00f4nes et logos servent \u00e0 identifier les articles. Jusqu'au paiement int\u00e9gral, les marchandises vendues restent la propri\u00e9t\u00e9 du commer\u00e7ant.<\/p>\n<h4><strong>Droit de licence<\/strong><\/h4>\n<p>Conform\u00e9ment \u00e0 la jurisprudence actuelle de la Cour f\u00e9d\u00e9rale de justice (BGH, arr\u00eat du 17 juillet 2013 - I ZR 129\/08), les commer\u00e7ants sp\u00e9cialis\u00e9s sont tenus de documenter la l\u00e9galit\u00e9 et la l\u00e9gitimit\u00e9 des logiciels propos\u00e9s. Les licences de logiciels ne peuvent \u00eatre mises sur le march\u00e9 qu'avec l'accord du titulaire des droits. La licence est accord\u00e9e en contrepartie d'un paiement qui permet d'obtenir une r\u00e9mun\u00e9ration correspondant \u00e0 la valeur \u00e9conomique du logiciel. Le titulaire des droits oblige le commer\u00e7ant \u00e0 vendre le logiciel de mani\u00e8re permanente, sans en limiter l'utilisation dans le temps. Le consommateur est inform\u00e9 que le logiciel est soumis aux conditions de licence et aux droits d'utilisation du produit du fabricant du logiciel.<\/p>\n<p>L'acqu\u00e9reur dispose d'un droit d'utilisation simple et illimit\u00e9 du logiciel. Il n'a pas le droit de le copier ni de le c\u00e9der \u00e0 d'autres pour utilisation.
